These terms govern the rental of any vehicle from RoadAirFly. By making a booking, taking delivery of a vehicle, or using roadairfly.com, you accept these terms. Please read them before you book — they set out what is expected of you as a driver and what you are responsible for while the vehicle is in your care.
1. Eligibility to Rent
- You must be at least 21 years of age at the time of the rental.
- You must hold a valid Indian driving licence, held for at least one year, valid for the category of vehicle being rented. International visitors must hold a valid International Driving Permit alongside their national licence.
- The licence must be presented in original at handover. Photocopies and photographs are not accepted.
- You must provide government photo identification for verification and complete the rental agreement in person.
- We may decline a rental where documents cannot be verified, or where we reasonably believe the vehicle would not be operated safely or lawfully.
2. Booking and Confirmation
A booking is confirmed only once we have acknowledged it and any required advance payment has been received. Vehicle models shown on the website are indicative of the category booked.
Where the exact vehicle booked is unavailable due to damage, delay in return by a previous customer, or maintenance, we will offer a vehicle of the same or higher category, or a full refund of amounts paid.
3. Security Deposit
A refundable security deposit is payable before handover. The amount depends on the vehicle category and is confirmed at the time of booking.
The deposit is refunded after the vehicle is returned and inspected, subject to deductions for damage, missing fuel, extra kilometres, late return, traffic violations, cleaning where the vehicle is returned in an unreasonable condition, or any other charge under these terms.
4. Fuel Policy
Vehicles are supplied with a recorded fuel level and must be returned at the same level. Where fuel is short, the difference is charged at the prevailing pump rate plus a refuelling service fee.
Fuel used during the rental is your responsibility. We do not refund unused fuel where a vehicle is returned with more than it was supplied with.
5. Kilometre Limits
Rentals include a daily kilometre allowance, confirmed at booking. Kilometres beyond the included allowance are charged at the per-kilometre rate applicable to that vehicle.
Unlimited-kilometre packages, where offered, are stated explicitly on the booking confirmation.
6. Use of the Vehicle
The vehicle must be operated lawfully and with reasonable care. The following are not permitted:
- Driving under the influence of alcohol, drugs or any substance that impairs driving.
- Allowing any person who is not named on the rental agreement to drive the vehicle.
- Use for racing, motorsport, performance testing, driving instruction, or any competitive event.
- Use to carry passengers or goods for hire or reward, including as a taxi or commercial delivery vehicle.
- Use to push, tow or propel any other vehicle or trailer.
- Driving on unmade roads, beaches, river beds, flooded roads or terrain the vehicle is not designed for.
- Carrying more passengers than the vehicle is registered to seat, or loading beyond its rated capacity.
- Transporting illegal, hazardous or prohibited goods.
- Smoking inside the vehicle.
- Taking the vehicle outside the geographic limits agreed at booking without prior written permission.
7. Damage, Breakdown and Accidents
Inspect the vehicle at handover and raise any existing damage before you drive away. A condition report is completed and signed by both parties.
In the event of an accident, you must inform us immediately, report the matter to the police where required by law, and not admit liability on our behalf. You must obtain a copy of the First Information Report or police report where one is filed.
In the event of a breakdown, stop safely and contact us before arranging any repair. Repairs carried out without our authorisation are not reimbursed.
You remain responsible for damage caused by negligence, misuse, or any breach of these terms, including damage not covered by insurance and the applicable insurance excess.
Loss of keys, documents or accessories is chargeable at replacement cost.
8. Insurance
Vehicles carry insurance as required under the Motor Vehicles Act. Cover is subject to the policy terms and to an excess payable by you in the event of a claim.
Insurance does not apply where the vehicle was being used in breach of these terms — including driving without a valid licence, under the influence, or by an unauthorised driver. In such cases you are liable for the full cost of loss or damage.
9. Traffic Violations and Fines
You are responsible for all traffic violations, challans, parking penalties, toll charges and related administrative fees incurred during your rental period, whether notified during the rental or afterwards.
Where a penalty is received by us after the rental has ended, we will notify you and recover the amount, together with a reasonable administration fee.
10. Late Return
The vehicle must be returned at the agreed date, time and location. A grace period may be applied at our discretion, after which late return is charged on an hourly basis, up to a full additional day.
If you need to extend, contact us before the return time. Extensions are subject to availability and to payment in advance.
11. Delivery and Collection
Delivery and collection at the airport, railway station, your doorstep or a hub location may be available for an additional charge, confirmed at booking.
You or an authorised representative must be present at the agreed time. Waiting beyond a reasonable period may attract a charge.
12. Our Right to Repossess
We may recover the vehicle without notice, at your cost, where it is being used in breach of these terms, where payment is overdue, where the vehicle is not returned at the agreed time, or where we reasonably believe it is at risk.
13. Limitation of Liability
We are not liable for indirect or consequential loss, including missed flights, missed appointments, loss of earnings or the cost of alternative transport, arising from vehicle breakdown, delay or non-availability.
Our total liability in connection with any rental is limited to the amount you paid for that rental.
Personal belongings left in the vehicle are your responsibility. We are not liable for their loss or damage.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
14. Governing Law and Jurisdiction
These terms are governed by the laws of India. Any dispute arising out of or in connection with a rental is subject to the exclusive jurisdiction of the courts at Chandigarh.
15. Changes to These Terms
We may revise these terms from time to time. The version in force at the time of your booking applies to that rental.
